I previously filed for Bankruptcy, but because of circumstances beyond my controll I need to file Bankruptcy again. Do I qualify for another Bankruptcy Discharge?
It depends on what Chapter was your last filed Bankruptcy and whether you received a discharge. Moreover, your bankruptcy filing is in good faith.
If you filed for Chapter 7 Bankruptcy and received a discharge, here are your options:
- You can file for another Chapter 7 Bankruptcy at least 8 years from the filing date of your previous Chapter 7 Bankruptcy in order to receive a Bankruptcy Discharge.
- You can file for a Chapter 13 Bankruptcy at least 4 years from the filing date of your previous Chapter 7 Bankruptcy in order to receive a Bankruptcy Discharge.
If you filed for Chapter 13 Bankruptcy and received a discharge, here are your options:
- You can file for a Chapter 7 Bankruptcy at least 6 years from the filing date of your previous Chapter 13 Bankruptcy in order to receive a Bankruptcy Discharge.
- You can file for another Chapter 13 Bankruptcy at least 2 years from the filing date of your previous Chapter 13 Bankruptcy in order to receive a Bankruptcy Discharge.
The above are general rules and as to all general rules there are always exceptions.
